The respondent objects to the inclusion of the site on a number of grounds. Reference is made to an original planning application for Heol Derwen which was refused by planners but granted on appeal. The respondent states that the planners concerns are still valid today. It is claimed that the land forms a barrier between existing residential and industrial units, with recent developments meaning that industrial development is getting closer to residential. It is claimed that there is no viable access into the site. It is claimed that the site minimises the impact of the development of Cross Hands East Strategic Site access road and protects the Mynydd Mawr Special Area of Conservation. The respondent states that public bodies have a duty to protect these Habitats.
